Legislation in Italy

Castles and, more generally, cultural heritage are governed in terms of protection, conservation and enhancement by national and regional legislation of considerable interest, which owners, administrations and technicians must be adequately aware of in order to take appropriate action to preserve and hand down to the future a heritage of considerable importance.

Primary legislative power under Title V of the Constitution is reserved to the State with regard to the protection of cultural heritage, while the conservation and enhancement of cultural heritage is a concurrent legislative competence, shared between the State and the Regions.

The administrative competences regarding the valorisation of cultural heritage are attributed by Legislative Decree 267/2000 to the Provinces.

In the Special Statute Region of Friuli Venezia Giulia, the Region only has supplementary legislative powers.
